Terms & Conditions

These Terms & Conditions apply to services provided by London CAD & Survey Services.
By instructing London CAD & Survey Services to provide services, you agree to these Terms & Conditions.
These terms explain how our services operate, what is included within an agreed scope of work, and the responsibilities of both London CAD & Survey Services and our clients.
1. About London CAD & Survey Services
London CAD & Survey Services provides measured building surveys, CAD drafting, residential design and related surveying and drawing services.
Our services may be provided to homeowners, architects, property developers, interior designers, builders, contractors and other professional clients.
Residential planning services are now delivered through our specialist service, Easy Architecture. Where a client engages Easy Architecture for residential planning services, the terms applicable to that service will be provided separately.

2. Services and agreed scope
The services provided will be those specifically described in the quotation, proposal, written confirmation or other agreed scope of work.
London CAD & Survey Services provides services including:
- Measured building surveys
- CAD drafting and drawing services
- Residential design and drawing services
- Drone surveys and aerial imagery
- Party Wall advice and related assistance where specifically agreed
Services or work not expressly included within the agreed scope are not included in the quoted fee.
Where additional work is requested or becomes necessary because the scope of a project changes, additional charges may apply.
3. Quotations and acceptance
Quotations are based on the information available to us when the quotation is prepared.
A quotation may need to be revised where:
- The scope of work changes
- Information supplied by the client is materially inaccurate or incomplete
- Additional site visits are required
- Additional drawings or documentation are requested
- Circumstances arise that could not reasonably have been identified when the quotation was prepared
A contract for the agreed services is formed when the client accepts our quotation or otherwise instructs us to proceed and London CAD & Survey Services confirms acceptance.
The quotation and agreed scope of work should be read together with these Terms & Conditions.
4. Client responsibilities
The client must provide reasonable cooperation and information necessary for us to carry out the agreed services.
This may include:
- Providing accurate property and project information
- Providing existing drawings or documents where relevant
- Providing access to the property and areas to be surveyed
- Providing reasonable notice of any known hazards or restrictions
- Ensuring that the property is reasonably accessible at the agreed time
- Reviewing drawings and documents provided for approval
- Informing us of any known alterations, unusual conditions or other matters that may affect the work
We are not responsible for errors, omissions or additional work arising directly from inaccurate, incomplete or misleading information supplied by the client or another third party.
5. Site access and health and safety
The client must provide safe and reasonable access to the property and areas required for the agreed services.
We reserve the right to postpone, suspend or decline work where, in our reasonable opinion, conditions present an unacceptable health and safety risk.
This may include unsafe access, structural instability, dangerous animals, hazardous substances, severe weather or other conditions that make the work unsafe.
Any additional visit required as a result of unsafe or unavailable access may be chargeable.
6. Measured building surveys
A measured building survey is a record of the building based on measurements and observations made during the agreed survey visit.
The scope and level of detail of the survey will depend on the requirements agreed with the client.
A measured survey does not constitute:
- A structural survey
- A building condition survey
- A building pathology investigation
- A utilities survey
- A legal boundary survey
- An investigation of concealed construction
- An investigation of materials or elements that cannot reasonably be observed or accessed
Furniture, stored items, finishes, vegetation, restricted access and other obstructions may prevent certain dimensions or features from being directly observed or measured.
Where an area cannot reasonably be accessed or measured, this may be identified to the client.
7. Verification of measurements and site conditions before construction
A measured survey records the property as observed and measured at the time of the survey.
Existing buildings may contain variations, movement, alterations, concealed construction or other conditions that may not be apparent during the survey.
All dimensions, levels, locations and other information shown on drawings must be checked and verified on site by the client, contractor and/or other appropriately qualified person before any construction, fabrication, installation or other works commence.
Drawings prepared by London CAD & Survey Services must not be treated as a substitute for site verification or construction setting-out.
The client and contractor are responsible for ensuring that dimensions and site conditions are checked immediately before construction or other physical works begin.
London CAD & Survey Services accepts no responsibility, to the extent permitted by law, for loss, damage, additional costs, construction errors or other consequences arising from dimensions, information or site conditions that were not independently verified before work commenced, or from information supplied by the client or another third party that was inaccurate or incomplete.
8. CAD drawings and design services
Drawings and CAD documentation are prepared for the purpose and scope agreed with the client.
Unless specifically agreed otherwise, planning and architectural drawings are not construction drawings, structural drawings or construction setting-out information.
Clients and contractors must obtain appropriate building control, structural engineering and construction information where required before commencing works.
Where existing drawings, dimensions, photographs or other information are supplied by the client, London CAD & Survey Services may reasonably rely upon that information unless a separate verification or survey service has been agreed.
Clients should carefully review drawings before approving them for issue or submission and notify us of any errors or omissions they identify.
9. Construction and setting-out
London CAD & Survey Services provides surveying, CAD and design-related services only.
We do not undertake construction, fabrication, installation or building setting-out works.
We are not responsible for the way in which contractors, tradespeople or other third parties interpret or implement drawings.
Contractors and other persons carrying out physical works are responsible for checking dimensions, levels, site conditions, construction details and suitability of the proposed works before commencing construction.
10. Structural engineering
London CAD & Survey Services does not provide structural engineering, structural calculations or structural design services.
Where structural engineering input is required, the client must appoint an appropriately qualified structural engineer.
Any structural calculations, structural design, structural advice or associated engineering documentation provided by an independent structural engineer is the responsibility of that engineer.
London CAD & Survey Services is not responsible for structural engineering decisions, calculations or designs produced by an independent third party.
11. Residential planning services and Easy Architecture
London CAD & Survey Services provides surveying, CAD and related services.
Specialist residential planning services for straightforward home extensions and loft conversions are delivered through Easy Architecture.
Where a client engages Easy Architecture for planning services, those services are subject to the applicable Easy Architecture terms and conditions.
London CAD & Survey Services does not guarantee that planning permission, a lawful development certificate or any other statutory approval will be granted.
Where London CAD provides drawings or surveying information for use within a planning application, responsibility for the planning service itself will depend on the scope of the relevant instruction.
12. Party Wall matters
Party Wall matters can involve specific statutory requirements and specialist professional responsibilities.
Where agreed as part of our service, London CAD & Survey Services may provide general Party Wall advice or assistance and help clients identify potential Party Wall matters at an early stage.
Unless expressly agreed otherwise in writing, London CAD & Survey Services does not act as a Party Wall Surveyor.
Where a Party Wall Surveyor is required, the client should appoint an appropriately qualified specialist.
Any professional advice or services provided by an independent Party Wall Surveyor remain the responsibility of that professional.
13. Drone surveys and aerial imagery
Where drone services are provided, the scope will be agreed with the client before the work takes place.
Drone operations are subject to weather, site conditions, safety considerations, airspace restrictions and applicable legal requirements.
Where safe or lawful operation is not possible, the survey or imagery may need to be postponed, modified or cancelled.
Drone imagery is not necessarily a measured survey and should not be relied upon as a substitute for physical measurement unless specifically agreed.
14. Amendments and additional work
The agreed quotation covers the scope specifically identified.
Reasonable amendments within the agreed scope may be included where appropriate.
Additional charges may apply where the client:
- Changes the agreed brief
- Requests additional drawings or documents
- Requests substantial or repeated revisions
- Requires additional meetings or consultations
- Requires additional site visits
- Provides new information that materially changes the scope
- Requires work following a third-party request that falls outside the original scope
- Requires work that was not included in the original quotation
Where additional charges are applicable, we will normally explain the additional work and proposed fee before proceeding.
15. Fees and payment
Our professional fees will be confirmed in the quotation or written agreement.
Payment terms will be stated in the quotation or invoice.
Unless otherwise agreed, invoices are payable by the date specified on the invoice.
We may pause work where an invoice remains unpaid, subject to applicable law and the client's statutory rights.
Third-party and statutory charges are separate from our professional fees unless expressly stated otherwise.
These may include:
- Planning application fees
- Building control fees
- Structural engineering fees
- Specialist survey fees
- Specialist reports
- Party Wall Surveyor fees
- Other professional or statutory charges
16. Delays and timescales
Any timescale provided by London CAD & Survey Services is an estimate unless a specific completion date has been expressly agreed in writing.
Timescales may be affected by:
- Client delays
- Delayed information or approvals
- Local authority delays
- Third-party consultants
- Restricted access
- Weather conditions
- Technical problems
- Other circumstances outside our reasonable control
We will make reasonable efforts to keep the client informed where a material delay occurs.
17. Client approval of drawings
Where drawings or documents are issued to the client for approval, the client should review them to confirm that they reflect the agreed scope of work and the requirements discussed with London CAD & Survey Services.
The client should notify us of any changes or corrections required before the drawings are finalised, issued or submitted.
London CAD & Survey Services is responsible for preparing the agreed drawings with reasonable care and skill. Client approval does not transfer responsibility for the professional preparation of the drawings to the client.
Any changes requested after the drawings have been approved may constitute additional work and may be subject to an additional charge.
18. Copyright and use of drawings
Copyright in drawings, CAD files, documents, photographs and other original work produced by London CAD & Survey Services remains with London CAD & Survey Services unless otherwise agreed in writing.
Once all applicable fees have been paid, the client is granted permission to use the final drawings and documents for the project for which they were prepared.
The drawings and documents must not be resold, reproduced for unrelated projects or materially altered and represented as the work of another person without our written permission.
Third-party copyright and intellectual property rights remain unaffected.
19. Third-party services
London CAD & Survey Services may work alongside or coordinate with independent third-party professionals.
These may include structural engineers, Party Wall Surveyors, architects, builders, planning consultants and other specialists.
Unless expressly agreed otherwise in writing, London CAD & Survey Services is not responsible for the professional services, calculations, advice, decisions, omissions, fees or delays of independent third parties.
Where we introduce or recommend another professional, any resulting appointment is normally between the client and that professional.
20. Limitation of liability
We will provide our services with reasonable care and skill.
Nothing in these Terms & Conditions excludes or restricts liability that cannot legally be excluded or restricted.
Subject to that, London CAD & Survey Services will not be responsible for loss, damage, cost or expense arising from matters outside the reasonable scope of the services we agreed to provide, including:
- Inaccurate or incomplete information supplied by the client or a third party
- Concealed, inaccessible or subsequently altered building conditions
- Failure to verify dimensions, levels or site conditions before construction
- Construction, fabrication, installation or setting-out carried out by others
- Structural engineering or other specialist professional services provided by third parties
- Decisions made by planning authorities, building control bodies or other statutory authorities
- Changes made to drawings or documents by others
- The use of drawings for purposes for which they were not prepared
- Delays or failures caused by third parties
- Events outside our reasonable control
Where London CAD & Survey Services is legally liable for a loss, liability will be limited to the loss directly arising from our failure to exercise reasonable care and skill in providing the agreed services, subject always to any limitations that cannot lawfully be applied.
Nothing in these Terms & Conditions affects any statutory rights available to consumers.
21. Cancellation and termination
A client may cancel an instruction subject to any applicable statutory cancellation rights and the terms of the individual agreement.
Site survey cancellations
Where a site survey has been arranged, the client must provide at least 48 hours' notice if they need to cancel or rearrange the appointment.
Where less than 48 hours' notice is provided, a £350 cancellation fee will apply, unless London CAD & Survey Services agrees otherwise or the cancellation is due to circumstances outside the client's reasonable control.
Where services have already been provided before cancellation, the client may be required to pay for services properly performed up to the point of cancellation where permitted by law.
Where a consumer has a statutory cancellation right for a distance or off-premises contract, that right will apply in accordance with applicable legislation.
If the client asks us to begin providing services during an applicable cancellation period, any required request, acknowledgement or consent will be obtained before work begins.
We may suspend or terminate an instruction where there is a valid reason, including non-payment, unsafe site conditions, failure to provide information reasonably required to perform the work, or circumstances that make the agreed services impractical.
Where we terminate an instruction for reasons that are not the client's fault, any refund due will be dealt with in accordance with the applicable agreement and consumer law.
22. Complaints
If you are unhappy with any aspect of our service, please contact us as soon as possible so that we have an opportunity to investigate and resolve the matter.

We will consider the complaint and respond within a reasonable period having regard to the nature and complexity of the issue.
Nothing in this section affects any statutory rights or remedies available to you.
23. Events outside our reasonable control
We will not be responsible for delay or failure to perform our obligations where this is caused by circumstances outside our reasonable control.
This may include severe weather, natural events, disruption to utilities or communications, government action, changes in law, local authority delays, third-party failures, illness, road closures, mechanical problems or other circumstances that could not reasonably have been prevented.
We will take reasonable steps to minimise the effect of such circumstances and resume the affected service when reasonably possible.
24. Entire agreement
The quotation, agreed scope of work and these Terms & Conditions constitute the agreement between London CAD & Survey Services and the client in relation to the relevant services.
Any material variation to the agreed scope should be confirmed in writing.
25. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision shall be treated as modified or removed to the extent necessary, without affecting the validity of the remaining provisions.
26. Third-party rights
Unless expressly stated otherwise, these Terms & Conditions do not confer any rights on a person who is not a party to the relevant agreement.
27. Governing law
These Terms & Conditions are governed by the law of England and Wales.
Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights a consumer may have under applicable law.
